Saudi Labor Law: Resignation & Termination Provisions

1. Mutual Agreement Resignation

  • Both employer and employee agree to terminate the contract.
  • No notice period is required if both parties agree.
  • Employee is entitled to end-of-service benefits (EOSB) based on service duration.

2. Resignation Before 2 Years

  • If an employee resigns before 2 years, they are not entitled to any EOSB.
  • A notice period (typically 30 days) must be served.

3. Resignation (2 to 5 Years)

  • If resigning after 2 years but before 5 years, employee gets 1/3 of the EOSB.
  • EOSB is calculated as half a month's salary for each year.

4. Resignation (5 to 10 Years)

  • If resigning after 5 years but before 10 years, employee gets 2/3 of the EOSB.

5. Resignation After 10 Years

  • If resigning after 10 years, the employee is entitled to full EOSB.
  • Full EOSB = 1 month's salary for each year after the first 5 years + half month for the first 5 years.

6. End of Contract / Termination (Art 77)

  • If the contract expires or employer terminates without reason, employee gets full EOSB.
  • Additional compensation may apply under Article 77.

  • Salary: EOSB is calculated on the last drawn total salary.
  • Disputes: Can be raised at the Saudi Labor Office.

How do I calculate EOS in Saudi Arabia?

Enter your total salary, joining and leaving dates, and reason for leaving. The calculator applies half a month's wage per year for the first 5 years and a full month's wage per year after 5 years, then adjusts for resignation or termination automatically.

What is the difference between resignation and termination EOS?

On termination or end of contract you generally receive full EOSB. On resignation the benefit is reduced: nothing under 2 years, one-third from 2–5 years, two-thirds from 5–10 years, and full EOSB after 10 years.
